Because MCS is owned by an Indian tribe as defined in 13 CFR 124.3, a definition that expressly includes state-recognized tribes such as the MOWA Band, agencies may award sole-source 8(a) contracts to MCS above the competitive thresholds that apply to individually owned 8(a) firms (13 CFR 124.506(b); FAR 19.805-1).
The MOWA Band is recognized by the State of Alabama and is not federally recognized. SBA's definition of an Indian tribe in 13 CFR 124.3 expressly includes state-recognized tribes, so MCS's 8(a) certification and tribal sole-source authority apply in full. Programs that separately require federal recognition, such as the Buy Indian Act, are outside that definition.
